Your Rights

When it comes to your health information, you have certain rights. These rights include obtaining an electronic or paper copy of your medical record; asking us to correct information you believe is incorrect or incomplete; requesting confidential communications; asking us to limit certain uses or disclosures; obtaining an accounting of certain disclosures; receiving a copy of this Notice; choosing an authorized personal representative; and filing a complaint if you believe your privacy rights have been violated.

Get an Electronic or Paper Copy of Your Medical Record

You may ask to see or obtain an electronic or paper copy of your medical record and other health information we maintain about you. We will generally provide a copy or summary within the time required by applicable law and may charge a reasonable, cost-based fee as permitted by law.

Ask Us to Correct Your Medical Record

You may ask us to correct health information about you that you believe is incorrect or incomplete. We may deny certain requests as permitted by law. If we deny your request, we will explain the reason in writing as required by applicable law.

Request Confidential Communications

You may ask us to contact you in a specific way — for example, at your home, cell phone, or office — or to send correspondence to a different address. We will accommodate reasonable requests.

Ask Us to Limit What We Use or Share

You may ask us not to use or share certain health information for treatment, payment, or healthcare operations. In many circumstances, we are not required to agree. If you pay for a healthcare service or item completely out-of-pocket, you may ask us not to share information about that service or item with your health insurer for purposes of payment or healthcare operations. We will honor that request unless applicable law requires disclosure.

Get a List of Certain Disclosures

You may request an accounting of certain disclosures of your health information. This generally includes certain disclosures made during the six years before the date of your request, subject to exceptions established by law. We will provide one accounting within a 12-month period without charge and may charge a reasonable, cost-based fee for additional requests within that period.

Get a Copy of This Notice

You may request a paper copy of this Notice at any time, even if you previously agreed to receive it electronically. We will provide a copy promptly.

Choose Someone to Act for You

If you have given someone medical power of attorney or another person has legal authority to act for you, that person may exercise your rights and make choices concerning your health information as permitted by law. We will verify appropriate authority before acting on their behalf.

File a Complaint

If you believe your privacy rights have been violated, you may file a complaint with Caribbean Chiropractic Center LLC using the contact information in this Notice. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.

Your Choices

For certain health information, you may tell us your preferences regarding what we share, including information shared with family members, friends, or others involved in your care, and information shared in a disaster-relief situation. If you are unable to tell us your preference, we may share information when we believe doing so is in your best interest and is permitted by law. We may also share information when necessary to lessen a serious and imminent threat to health or safety when permitted by law.

Marketing and Sale of Information

We will obtain your written authorization for uses and disclosures of protected health information for marketing purposes when HIPAA requires authorization. We will obtain authorization before selling protected health information when required by law. Caribbean Chiropractic Center LLC does not sell patient medical information.

How We Typically Use or Share Your Health Information

Treatment: We may use your health information and share it with other healthcare professionals who are treating you. Run Our Practice: We may use and share health information to operate our practice, improve our services, coordinate care, evaluate performance, and contact you when necessary. Billing and Payment: We may use and share your health information to bill and obtain payment from health plans, insurance companies, or other entities responsible for payment.

Other Ways We May Use or Share Your Information

We may use or disclose your health information in other ways permitted or required by law, including for public health and safety activities; health research as permitted by law; compliance with legal requirements; health oversight; workers' compensation; certain law-enforcement purposes; lawsuits and legal proceedings; coroners, medical examiners, and funeral directors; and certain specialized governmental functions.

Uses Requiring Your Written Authorization

For uses and disclosures not permitted by this Notice or applicable law, we will obtain your written authorization. If you provide authorization, you may revoke it in writing at any time, except to the extent that we have already relied upon your authorization.

Substance Use Disorder Records

To the extent Caribbean Chiropractic Center creates, receives, or maintains substance use disorder patient records subject to 42 CFR Part 2, those records receive additional federal protections. Such records will not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you unless permitted by applicable law, including where required consent or a qualifying court order and subpoena have been obtained.

Our Responsibilities

Caribbean Chiropractic Center LLC is required by law to maintain the privacy and security of protected health information. We will maintain appropriate safeguards; follow the privacy practices described in this Notice while it is in effect; provide you with a copy upon request; notify you following a breach of unsecured protected health information when notification is required by law; and use or disclose your information only as permitted by law or as authorized by you.

Electronic Communications

Caribbean Chiropractic Center may use electronic systems to communicate with patients regarding appointments, billing, treatment, or other healthcare matters. Electronic communication may include patient portals, email, telephone, or text messaging when appropriate and permitted by law. Because ordinary email and SMS messaging may present privacy risks, patients should avoid transmitting highly sensitive medical information through unsecured communication methods unless instructed otherwise.

Changes to This Notice

We reserve the right to change the terms of this Notice and our privacy practices as permitted by law. Changes may apply to health information we already maintain as well as information we receive in the future. When we make a material change, the revised Notice will be available at our office, upon request, and on our website at www.caribchirovi.com.
